What is Eminent Domain?

Eminent domain is the power that the federal, state, and local governments have to take property for public purpose projects, such constructing buildings, widening or creating roads, and further developing mass transit. So long “taking” is for a public purpose and all laws have been complied with, the only rights of property owners are for the “fair value” of their property.

What is Fair Value?

Fair value is highly subjective. The government often will “low-ball” property owners in determining fair value because they know most property owners will not object.
